We are happy to review any accident that caused serious injury or death to determine whether you might have a legal claim.

When the accident was the fault of another party—a person, business, organization, or government agency—they could be liable for your injuries. Our experienced attorneys in Fort Myers can investigate any accident to identify parties whose conduct may have caused or contributed to the incident that led to your injuries. We work to hold those parties accountable and ensure you receive fair compensation.

While we are investigating, we could also help you and your family with practical issues. We could make payment arrangements with healthcare providers and other creditors, helping to relieve financial strain during your recovery.

A Legacy of Advocacy. A Commitment to Community.

Founded in 2005 by Frank Aloia, Jr. and Ty Roland, our firm was built on a clear vision: deliver exceptional legal advocacy while staying deeply connected to the community we serve.

Our attorneys each bring over 30 years of legal experience, creating a foundation of knowledge and continuity that few firms can match. Located in the heart of downtown Fort Myers, just steps from the courthouse, our office reflects our role at the center of the legal community.

We actively partner with organizations across Southwest Florida, including Community Cooperative, Edison-Ford Winter Estates, and Rotary. For us, success isn’t measured only by case results, but by impact—supporting efforts that improve public safety and strengthen the community we call home.

That same commitment extends into the courtroom. As true trial lawyers, we’ve handled and tried more cases than many firms in the region. Two of our partners are board-certified in civil trial law—a distinction held by less than 1% of attorneys in Florida—reflecting our proven skill and dedication to excellence.

Aloia | Roland | Lubell has long been one of Southwest Florida’s best-kept secrets. Today, more people are discovering what our community has known for years: when it matters most, experience, reputation, and relationships make all the difference.

How To Prove That You Are Entitled to Damages

The cornerstone of a personal injury case is proving negligence. When a person’s negligence causes harm to someone else, they owe the injured individual compensation. A person is negligent if they did not exercise reasonable care given the circumstances, and someone was hurt as a direct result.

Sometimes, there is a more demanding standard. For example, when someone is responsible for children, they must be diligent in protecting the child from potential harm that the child is too young to recognize. Similarly, commercial truck drivers are held to a higher standard than passenger car drivers because trucking is a for-profit enterprise and because truck accidents can be so devastating to people in smaller vehicles.

Our experienced Fort Myers lawyers understand the nuances in the law and know how to find compelling evidence of negligence in a personal injury case. They present this evidence to the responsible parties’ insurers and negotiate fair compensation for the losses you have suffered. You may be entitled to reimbursement for:

  • Pain and suffering
  • Medical expenses and lost wages
  • Future expenses like ongoing medical care or reduced earning capacity

An accomplished lawyer from our team will work to ensure that all your damages are fully documented and that your claim is handled efficiently and effectively.

What Are the Important Time Limits To Know?

It is critical to act quickly when you are injured or a loved one dies in an accident. Florida Statutes § 95.11 requires you to file an injury lawsuit based on negligence within two years of the incident that caused the injury. If you are a family member bringing a wrongful death claim, you must file within two years of your loved one’s death.

You must act even more quickly if a local government or government agency was involved in the incident. This situation could arise if you were hurt on government property, you were involved in an accident with a municipal vehicle, like a police car, city bus, or garbage truck, or were injured by fireworks at a city-sponsored celebration.

When the government is a potential defendant, you must notify the responsible office of your claim within 180 days of the incident. If you fail to give the proper notice, you lose the right to sue. Our Fort Myers attorneys will preserve your rights by timely filing all the required paperwork for your personal injury claim against an agency of the government.
